we should suggest that he sells the metro to pay for stuff...

Bailiffs take things to pay for debt... in my eyes, this works in exactly the same way, only we're effectively the bailiffs...

Good idea about the letter - we should do that...

Hi, sorry I know I'm not involved in this but taking justice into your own hands is not a good idea so I hope you are joking!

Best way to be honest is to send a letter (recorded) to Pie's home address if you know it, saying money or goods within 14 days or legal action will be taken. Then if he has not made positive contact within the deadline take it to small claims.

Only trouble being that, if he has spent everyone's money on his social life, you still won't get it back :ermm:

No i am not being serious yet, this is all of our's way of trying to make the best out of the situation that all of us TMF members have been put in. By keeping this light humour in the thread keeps the levels of anger some what down i would say, So please do rest assured that atm no "inforcive action" as of such will be taken by me and thank you for the idea of the letter with 14 days written notice, HOWEVER i really do hope that no one on the forum has to do that and that this can all be resolved peacefully as it is a shame that this situation has arisen.

Not a bad Idea. However he probobly wouldn't sell his car though. to be honest I would'nt blame him, we all need one. I do however think that looking into a smaller Bailiff company may do the trick? Not sure if individuals can actualy use bailiffs though?

I think we would have to use legal channels first.


I've been thinking...there is no reason for me to wait till the 3rd because all Pie has to send me is letter with money rather than a parcel. Even second class I should have recieved it yesterday if it was mailed Tues/weds. I'll give mine till end of today. If it's not here then I am on the Bandwagon for the 3rd with Roo.

probobly from all of us.I think it would be better that way as thats how the small claims court would be as we would be doing a joint claim. We'll see what today brings though! ***fingers crossed****

I have sent him a PM with a deadline... which i know he has recieved and Read.. effectively the same as sending a letter... Hes been online as his facebook is active and clearly been posting in other forums..

HE has until the 3rd... then i will be PM-ing him again.... notifylying of legal action.

Unfortunately the excuse that his computer is down seems to be null and void then eh'? Oh well. I hope I get my money today......

Perhaps it's not a bad idea as we can all see what's going on from your end. Should give us a decent direction so we can sing off the samr hym sheet with the potential claims suit.

Hello Pie!

Hope you had a great time at BH2N..

However i'm startiing to get a little annoyed that you still haven't found a way to return my money.

I feel i've been very patient about it so far as you said you would return it to me, but now its become beyond a joke and this is the last chance i'm giving you before i have to take it further.

I know you've had the money recently so there isn't any excuse why it shouldn't have made its way to me already, i know your new car was bought and alot of money was spent on the head.

I'm gonna give you until the 3rd of September to contact me to arrange ways to return the cash. If i haven't heard from you by then i will be forwarding this PM to Admin and taking it further...

If money was no object i wouldn't have worried about it so much but I have a mini to start repairing and i will require those funds very soon to start buying paint etc.

Now I wasn't going to go public about it until the 3rd.. But..... I've just got soo annoyed with him cause hes messed around so many people..

I just want everone to have what belongs to them returned.

It would probably be better in the courts eyes to see a formal letter sent via recorded delivery. Not sure how well a 'PM' would stand up in a court. Also, even if he is broke, he is in employment. I believe should a court case be won, the judge can be ordered that payments be taken automatically from a salary each month to pay off creditors.
