I agree you and your mate should contact the local Trading Standards office, the police and also VOSA ([email protected]) - this garage owner needs to be reported - if the car has been written off this car could be a stolen mini cloned as the crushed one.

Must admit the tax and MOT would be an issue as these are done electronically now and I would have thought something would flash-up somewhere but not if he's got dodgy ones.

A garage near where I lived kept having complaints to Trading Standards - infact he had so many about various things the Trading Standards actually took the unusual step of actually putting a full size advert in the local paper to tell people of him. This resulted in even more complaints to them and he was shut down and all the cars removed.

REPORT HIM from what I've read it would appear that he isn't very responsible about his obligations about selling motor vehicles. Keep a written record and printed record of everything and give it to trading standards. They may send someone to pretend to be a buyer and see if he is being honest and do an HPI check too. The police may take the vehicle away to inspect it and check its not a ringer.

Apologies but I've only just come across this thread. As much as it may be tempting to do harm against the garage the best approach would be to take legal action. The problem with a civil claim is that the courts do not look at the 'bargain' element of the contract. My advice would be to approach the authorities with a charge of 'obtaining a percuniary advantage by deception' contrary to the the Theft Act. It appears prima facie from the facts that this is the way forward.

If you approach it from a civil perspective you may find it expensive and difficult to prove.

Happy to advise if you drop me a line...

Not prima facia as mens rea needs to be proved. However as per my previous posts totally agree that cops should be notified and chap locked up.

Sorry to bring up an old thread, but was just curious (as I live near Scarborough) to know if this matter got solved. As i see the car often when i walk past the garage.

Decided to take a picture today to show its current state...

That's the car, it's still there. It's been there for over a year, and someone really needs to sue this guy, as from what I've heard he's a crook.

I've asked citizen's advice and if you can prove he's misdescribing the car (as in roadworthy etc) then he's open for being sued the pants off.

That looks like a stunner of a mini, I just put the number plate into the DVLA check:

The vehicle details for N407 WOM are:

Date of Liability 01 08 2008
Date of First Registration 21 12 1995
Year of Manufacture 1995
Cylinder Capacity (cc) 1275CC
CO2 Emissions Not Available
Fuel Type Petrol
Export Marker Not Applicable
Vehicle Status SORN Not Due
Vehicle Colour WHITE
Vehicle Type Approval null
The information contained on this page is correct at the time of enquiry.
Vehicle Excise Duty Rate for vehicle
6 Months Rate £66.00
12 Months Rate £120.00

So its taxed....would you be able to tax it if its on dodgey plates?

So that's the one is it? I had a quick look in there a couple of weeks back although he seemed to have more "normal" cars in stock than mini's which I'd never seen before in the few years I've been walking past/noseying at what he has.. and I thought it was a bit strange.

Glad this topic has been resurrected so hopefully more potential customers will be warned.

You should get your own HPI check done HPI checks before you take it further, then if it is running on dodgey plates, you have evidence...

If you refer back to earlier in the thread it gives the full story.

I've HPI checked the car a number of times, and that's where things get dodgy. N407 WOM was declared a category B total loss and crushed in 2002, which means the car should NEVER be returned to the road, only broken for spares, and the shell crushed.

The car is able to be MOT'd and taxed because at the moment the Tax and MOT computers are not linked to HPi.

If you bought this and tried to re-sell (as my mate did- see earlier in the thread) nobody would touch the car with a bargepole.

The fact is that the car was bought by the speacialist, knowing its history, for spares, for £150. The proprietor is now trying to pass the car off as legit and make a tidy profit.

Hmmm, I wonder who it was who rebuilt the car? Looking at it and the condition, possibly a new shell rebuild or at least a very late shell as the donor. Does the chassis number correspond to the V5 and the original before it was written off?
I can just imagine the guys face if you went in there, starte chatting to him, then did a HPI check over the phone and revealed to him the results, do you recon he'd sell it for £150? No, he'd have you out of there in a shot.
