Well if, as they said, the car was recorded as destroyed it wouldn't get reregistered. Neither would your friend have been able to get the V5 transfered to him.

Not strictly true, The modern system yes but when it was all files and paperwork no.
I had a sprite last year that was recorded as destryed.
Taxed and mot'd all legit.
It was a 1995 car that was "destryed in 1996"
Needless to say the car was put onto a q registration before i sold it.

I still have a cory of the original logbook.
Later books that were processed under the new system have a note on the front page declaring if it was a cat c write of and what date it was inspected.
Sadly cat D is not on there.

If a car slipped the system before it went to the newer computerised then it will still be issued with tax and mot.

DVLA did not hand type all details into the newer computerised system.
Sorry

From a profesional point of view............ deception......Report it. by reporting it you are mererly starting an investigation to establish the facts not "to get someone done" as is often the misconception.

Whitbytom!!!

DEFINATELY report this garage for this.

I bought a car from the same garage in April for £1750, an old K reg 850cc Morris Mini. He said it'd be sold with a full MOT and everything, etc. He did sell it to me with a full MOT. After having a couple of problems, I took it to a local mini mechanic here in Leeds where I live... he said the car was an absolute deathtrap! The subframes were knacked, the sills had massive holes (that had been filled in and painted over) the boot had holes in, the doors had holes in, bear in mind I knew nothing about minis and thought it was a good buy at the time.

I ended up taking the car back, with re-inforcements in the form of my dad!! and we got our money back, luckily.

That old guy there has a cheek, I think we should name and shame garages who rip people off like this.

Do NOT use the Pavilion garage in Scarborough!

I will happily remove the name if that isn't the correct garage but as far as I know that's the only mini specialist in that small town!

P.S. next time you go past see if there's a red 1973 K-Reg Morris Mini there, with white bonnet stripes and white 10" weller wheels, that's the one! All he's done, instead of sort out the problems, is fill the sills and steps back in and paint over them!

This story has got me SO annoyed! That garage really has a cheek and I shouldn't be surprised that he's ripped other people off.

I was told by my local mini mechanic, even if I was to get a refund (which I did), to take the garage that did the MOT - Kwik Fit in Scarborough - to the Ministry - as they should've NEVER passed that car in the state it was in. Perhaps the guy at the Mini garage has a deal with the local MOT place? I remember the guy who sold me the car - his exact words were "we send the cars out to another place for their MOT's - that way it covers both me and you" - the scheming old pillock!

I didn't take it further at the time as I just wanted to forget about it all, and obviously without me still having ownership of the car (after taking it back) there wasn't much I could do with VOSA or whatever to prove the car was sold in an unroadworthy state.

Please, please, please report him for whatever you can nail him for. The profit he must be making on those cars! I saw a (new) J reg automatic mini there a few months back, looked standard, didn't even have a sunroof, rust on the doors & A panels, up for £4250!!

EDIT - for anyone who's curious about the state of the car I was sold with a FULL MOT click HERE for pictures - they aren't very good quality but show the rot nonetheless.

Do NOT buy this car:

This is a very interesting storey and the thread should be kept alive to see the outcome. DO NOT ALLOW YOURSELF TO BE RIPPED OFF BY THIS GARAGE.

Hey Whitbytom, do we have any updates... reported etc....

I still think the best option would be to go to the garage as a potential buyer and ask all the right questions, accident, write off Hpi etc and see what he says, then go straight to the cop shop and duplicate the complaint with trading standards.

To go a step further when visiting the garage be a complete novice in so much as you have a question and answer sheet made out just like the one in autotrader etc. Or if you want to be really sneaky tape him when asking the questions! Just thinking on the best way to gather evididence and also confirm your suspicions that your mate has indeed been ripped off.

Cheers

Hi guys, yes the car is at the Mini 'Specialist' mentioned in the above posts. It seems like this fella has a history of pulling this kind of stunt....

Just before my mate sold the car to the garage for £150, just to be sure he asked me to do a HPI check on the car, as I worked in the trade at the time. I did a full experian check on the reg and sure enough the car came up as a total loss, and showed as being 'crushed' in 2004.

I'm gonna get in touch with my pal and try and get someone on the case, eg Watchdog or Rogue Traders, as in my experience this is somethign the police will do little/nothing about.

I'll try and get the car HPI'd again this week, and see what comes up.

In the world of sanctioned detections and performance figures a crime with a suspect on will not be forgotton or nothing done about out once a criminal offence has been established. The police will not do anything if its an identified civil dispute as its simply not there job. Many people expect wonderouos things from the police just because a law has been broken, just remember there is criminal and civil law and anly criminal is dealt with by the police. Rant over.
