Has anybody had problems with the service received by Jon Speed Racing Nuneaton?
I have a classic mini having the engine repaired and some minor body work carried out by them. It has been a very, very long process, nearly 2 years, and have had to write the following email. I'm sharing this so you understand my troubles so you do not fall into the same trap. I would also like to know if anyone has had problems as it is likely I am going to court for a resolution.
Dear Sir
I have not received a reply to my email dated 21 August 2018 regarding the repair of my Classic mini originally brought to you on March 2017. This email explained what you told me the progress you were making and what was left to do. Unfortunately this is not the case. I have called on many occasion asking for progress and you have repeatedly said you were not working on the car for one excuse or another. Three weeks ago I found out you no longer had the car and that it was with another garage. I was not informed prior to you moving the car. I have contacted this garage and they said the car was not ready for the rolling road as the engine was leaking air and needed further repair. They contacted you to collect the car which you have still not done.
We originally brought the car to you in March 2017 for you to respray the bonnet, tidy on the exterior, fix the brakes and repair the engine including putting the car on a rolling road. It should be noted that when the car was brought to you it was fully constructed with no parts missing. At this time you had car for 4 months and did not fix the front panel or put the car on the rolling road. As the car repairs were for my 40th birthday present my wife collected the car knowing these items had not been done but paid over 2 thousand pounds for the other items of work. You said to her that the car was fine to drive. I drove the car once and the engine seized. I arranged a lorry to bring the car back to you, costing me £250, with paint peeling of the bonnet and asked for the remaining work to be completed including you fixing problems you had already been paid for. Since this time I have contacted you on many, many occasions and you have given me excuse after excuse as to why the work has not been completed. Today I contact you to say I had had enough and asked if I could collect the car. You said I could not until I had paid for the work on the front bumper.
I am willing to pay for the front bumper if it has been complete and if it is satisfactory. However I would like a refund for the engine repair and the spay of the bonnet as this is not satisfactory quality under the Consumer Rights Act 2015. I also would like compensation for 2 unnecessary trips of lorry collection. 1 to bring it to you after the engine seized and the 2nd for collection of the vehicle following you failing to complete the work for nearly 2 years.
I would like a reply as soon as possible so that I know you have received this email. If you don't agree to the refund, could you please then send me a detailed response saying why you don't agree.
To avoid taking court action, I am willing to use Alternative Dispute Resolution to resolve this problem.
If I do not receive a satisfactory response from you within 30 days of the date of this email, I intend to issue proceedings against you in the county court without further notice. This may increase your liability for costs.
I refer you to the Practice Direction on pre-action conduct under the Civil Procedure Rules, and in particular to paragraph 4 which sets out the sanctions the court may impose if you fail to comply with the Practice Direction.
