Always do an HPi prior to buying .

However you were told the car had been in an accident and repaired, so I don't really see a problem apart from your resale value may be affected, but you were willing to buy it knowing it had been in an accident.

The trader probably had a clean v5c at time of purchasing (hence thinking it was unrecorded) and the previous keeper subsequently had the claim settled, hence the VIC marker coming in, and the delay of v5c to you.

Of course it may have been a write off twice - do a HPI and find out, a cheap text check will do,

Difficult one this. The accident was declared to the buyer, but he was explicitly told that it hadn't been written off. If the last bit is correct then I agree that he should go back to the seller and negotiate a partial refund as a cat c write off will reduce the value (that assumes he didn't buy it dirt cheap and the accident history wasn't reflected in the price). If the buyer hadn't asked if it had been written off and/or wasn't given the wrong information I would be with the seller - there's too much blame and people often forget the saying 'buyer beware'. An HPi check is easy to do. If the buyer wants an inspection he can have one BUT he was told that the car had been in an accident and having the inspection now is a bit like locking the stable door when the horse has bolted. Again, buyer beware.

The trader should tell the buyer.

The buyer asks and the trader should check. Simple.

The car will be worth less as a result and harder to sell on. This should have been reflected substantially in the purchase price.
Seems to me that the trader knew and used the "selling for a customer" line and giving some information to circumvent the full truth thus getting higher returns.

Name the company so others don't get caught out the same way please

Trader could well have checked it when he obtained the car but got categorised by the insurance company after sale hence the Vic marker. OP did say his logbook took ages

This "name and shame" nonsense doesn't help , we don't know all the facts

OP, go see trader and work something out, seems an honest mistake to me

Logbook taking time is usually a sign the v5 has to go through the system after being in salvage etc.

No name and shame as such, just protecting others. Very helpful to the mini community.

The previous owner owned the car since 2008. I believe it had a rear bump about 3 years ago & was repaired.
Now thinking about it the guy I bought it from maybe did not know it was written off as if the logbook was still the original in the previous owners name then it may not have been recorded on the logbook until change of ownership to me?

Hard luck but I guess you'll not be surprised by that, its a lesson learned for the future, check before you buy.
