He had no v5 for it but said he would get a new one and send it on to me
He knew I was buying the vehicle to restore for my daughter
I have now received v5 and hpi checked it and it comes up with a Scarapped vehicle marker on it
I have just emailed him telling him to sort it out, in case it is an error from dvla
What more can I do before I name and shame him and pay him a visit

When you say scrapped how have you got a v5? Do you mean its cat c or d? Unless you can prove that the seller stated otherwise that is your department to check I'm affraid, buyer beware! :-(

The vehicle didn't come up on it before but does now i have v5, when I ran a check it comes up as vehicle recored dvla scapped marker on condition report register
The trader is a fairly well known guy who sells at most of the big meets and sells online
I am giving him benefit of the doubt for now

If It was just registered off the the road it would be declared SORN, not scrapped. I'm fairly certain you need to fill out the scrapped section on the V5 document, then send it off. I don't understand how this could have been done by mistake.

after a bit of research on the web i found a post that is a way of checking for free and is pretty acurate apparantly
go onto Auto trader and start an advert if you put in car reg details it brings up if it is cat d c etc under the advert, and you can check by finding a cat d listed car on ebay enter its details
i tried this mine comes up clear but if i check a cat d listed audi A6 it comes up as cat d
hopefully mine is clear, just an error i dont think the dealer is dodgy but who knows
