You really have to watch it as a seller as well. Alot of people will just say it never arrived, and then claim it back from ebay if you dont refund them. On the other hand some sellers are just plain liars.

I bought vizards tuning mini for £10 +p&p . Photo looked good , clean etc , did say it was used . I recieved the book and it wasnt the one pictured .It was held together with brown parcel tape and filthy , it looked like some one had dipped it in espresso .

The person refunded me but didnt apologise or anything , so i had to get another , and i was down for paying the return postage .

Wonder if he's on here ???????

If you won an item on Ebay the seller is duty bound to sell it too you.

No they are not. You might be by eBay's rules but they are worthless. Ebay is not an auction site as auctions do not have time limits. Ebay therefore just comes under normal contract law. This means the seller can pull out of the sale at any point and just refund the money to the buyer as long as neither party benefits. eBay uses feedback as a way to scare people into completing transactions because they make a percentage from them. It is in their interest that a sale is completed but they can't force a seller to sell an item.

In answer to the OP's questions I would continue with the messages. If you want, pay with paypal. If you don't get the item or any response within a week you can open an unpaid item case. Worse case scenario is that you will be refunded.

With the 20 free listings you get on ebay I don't understand why people don't just list things for 30 days at a fixed price. It makes selling stuff much easier and quicker. I've shifted far more stuff on ebay this way than with auctions as people don't leave it to the last minute and then realise they missed the auction. As soon as they click 'buy' the item ends.

I've had people try this with me. This is why I use myhermes courier to send everything now. A. they are cheaper than the royal mail and B. you can track your parcels.

If an item is collection only I straight away refund people if they pay by paypal. Most people are ok with this but I did have one guy who got really arsey with me when he turned up as I asked for cash on collection. He left without paying for the item or taking it. I reckon he was going to collect it then claim he never got it so he could get a refund.

The fact f the matter is, eBay just make it up as they go along.

They are also unfair towards sellers.

I just use eBay now to purchase from the shops on there, I don't sell any more and i don't like to buy from private sellers.

I too used to sell laptops on there which i refurbished myself. You can't get rich doing it by any stretch of the imagination but it was steady money as i was constantly buying and selling them. I usually had a stock of over 50 in at any time.

One i sold was supposedly a birthday present for the buyers son. I sent it and heard noting more, then 3 weeks later, i had a message saying that she had given it to her son and it didn't work. I asked her to send it back to me and i would investigate (it was quite an expensive laptop) Instead, she opened up a dispute. eBay ordered me to give her a refund and her to send it back to me.

eBay then said i should give her the refund once i have received the laptop back but she had a certain time to send it back in.

A week later, i had a message from eBay telling me that as she hadn't provided them with any tracking info, i had won the case and no longer needed to give the refund.

Next day, the laptop turned up. I opened it and decided that i would refund her privately as a gesture of good will because she had sent the item back. I tested the laptop and there was nothing wrong with it which annoyed me because of all the grief of it all.

I ended up not refunding her because she enclosed a nasty letter with the laptop so i thought 'screw you'

Bottom line, keep perusing in case there is a genuine reason for no response but don't hold out too much hope, he doesn't have to send you the item after all.

I sold a really boring book once , as new condition for peanuts . The woman didnt contact me or pay me for 4 weeks ! Then she left me bad feedaback saying i didnt send things ! Mental ! Ive also bought new clothes that stink of fags , and been sent empty boxes !

It is a minefield . If im buying private stuff i try to speak to the person first to get a impression of the level of muppet they may , or may not be.

I've taken a deep breath and sent him another message - i was going down th 'ebay is a legal contract bla bla' route but figured humour was a better direction is wrote this....

Hi Derrick. Can you please reply to the messages i've been sending you so we can discuss what is happening regarding the wheels?  I get the impression that either you've lost the use of you fingers and can't type....or you just don't want to sell them at the price i won them for?  If it is the first reason, then i'm very sorry and maybe a pencil in the mouth will help you type a reply. If however it is due to the price being lower than you wished - please contact me and we'll sort something out as i was prepared to pay more.  Cheers, Dave

Yeah, but what if he wasn't expecting more money and has just been busy?

Now he will be expecting more money and probably having a good laugh also.

I would never offer more money for something that i won fair and square, i would simply follow it up for a week and if no reply, leave a negative feedback and look for another set of wheels.

Plus, i don't think your latest message (although funny) will help him to do the right thing. It will probably just piss him off

Shows how much faith you 2 have in a bit of sarcasm......it worked and i've had a message from him with phone number and a day to collect.

Plus - the wheels are super rare and expensive so worth chasing in my opinion as i do not want to buy new as they are for a rally car and get trashed straight away anyway.

And his response to the extra money - "you won them fair and square"

Nicely done. Sometimes, people are just busy. I listed an item once, and completely forgot all about it, so it was a couple of days after the auction ended before I even remembered. I apologised to the buyer and they were fine with it.

Like many have said, ebay is a minefield. I have sold a few things recently, and the ad said collection or postage available, but if collecting, cash only. They paid via PayPal and said I'll collect in 4 days. I replied, saying I will refund the paypal and please bring cash, and the reason why (too many people trying to claim they never received it etc). She didn't reply until about 2 days later, turned up when she said and paid no problem. She understood and there was no issue. Its just not worth the risk though.

I sold an iPhone 4S around 3-4 weeks ago, for a decent price actually. It turned up fine and she was perfectly happy. She emailed me a could of days ago saying its unusable as it turns off every five minutes. In the advert, I clearly said that when I was using it, there was an issue in that it would randomly turn off whenever the battery got down to about 15% or so. I also stated that I have used it since, as I changed phones and forgot all about it. Therefore, when she asked for a refund, I had to decline saying its been 3 weeks. If she got it and said the next day, I would have happily refunded her.

I sold some MTP combat trousers and described them as new. Well, I accidentally sent the worn pair, as I was sending many items. The guy wasn't impressed, as you would expect, so I sent him the correct ones, and told him as they were no use to me, he could keep the other pair and at the point he was more than happy.

I think the main reason for me being sarcastic was to just get a response...whichever way it went.  Plus because i'd done a bit of Facebook stalking i knew roughly his age and therefore figured he'd respond well to a bit of a jibe, whereas the younger generations would probably not appreciate it (or maybe just not get it). I grew up with Blackadder so like that sort of humour.

He did however, say he responded to my first message, so not sure if ebay are stopping messages for any reason.

All being well, i'll collect the wheels some time this weekend - but we will see.

Just for reference if you win an item you can do a "contact information search" here http://www.ebay.co.u...h?_sofindtype=9

This usually gives you the contact details including phone number of the other party (it will also send yours to them)

eBay is no different to this forum.
There are sellers that use it correctly, some that don't!

I've only been on here for a couple of months, and already been twice 'gazummped' if that's a word, by the seller not following the 'dibs' rule.

There are people with morals and people without.
It's just pot luck which one you end up dealing with.

Glad it worked out in the end.

Like i said, i would have been annoyed at the sarcasm so i'm glad it worked with the seller on this occasion.

Well done!

Ben
