Would it work though? Not sure how I would do one from an account though. I would of thought he would of had to of agreed to the transfer himself.

 

Well someone did it to Jeremy Clarkson didn't they, when he published his bank details a few years ago and dared someone to try it. In this instance he couldn't do you for stealing, since that is exactly what he has done. But yes he's probably spent it. Maybe try a tenner first to see what happens then fleece him! (Again I accept no responsibility!)

 

Pretty sure there are no checks. Of course you can't just go doing it to anyone because they will notice and inform their banks. But he couldn't, since I suppose he would risk exposing himself and his dirty tricks.

Ofcourse, I wouldn't dream of doing it to anyone else, but this always seems to happen to us good guys. But then again as his supposed girlfriend has said, he might be in prison.

I think it's highly unlikely you can just take money out of someones account, every criminal in the world would be at it. Why risk getting hurt robbing somewhere when they can just take the money from your account?

As for stealing from him is fine because he stole from you, no chance.

I'm afraid the truth of it is, your money is gone. You weren't careful about who you were dealing with and you've been had. The Action Fraud people probably think exactly the same and I don't imagine there is a great deal they can do when someone gives someone they have never met over a grand.

I like to be supportive but the advice you've been getting in the past few posts isn't good.

All you'll be able to do with them is put money into my account. Not take it out. Honestly, I've never known such a palaver about nothing," he told readers.

But he was proved wrong, as the 47-year-old wrote in his Sunday Times column.

"I opened my bank statement this morning to find out that someone has set up a direct debit which automatically takes £500 from my account," he said.

"The bank cannot find out who did this because of the Data Protection Act and they cannot stop it from happening again."

 

Not saying do it, just saying it can be done. And in this case what's the guy gonna do, sue?

Looks like I will have to give up then, dosent seem like much can be done. I will find it really hard to trust someone when buying something online again.

You don't have many rights unfortunately when buying things privately but you could still investigate court action. Surely there must be a way in law to get his address (from the bank?).

 

I wouldn't just give up. If it was me I'd be lived and marching on his house with Anne Robinson!

I have come up with a massive plan.. 

I don't want to put all the details but here are the basics...

Complain to cheif ( as it is voted the last thing he wants is me giving him a bad name) 

Get a name and address from them. 
 

file small claims court

hopefully win court with my evidence.
 

pay bailiffs

get most if not all of my money.

Let's roll.

The police are pretty useless to be honest.  I had an offroad motorbike stolen from an RAF base neither the civilian police or RAF police done anything other than take a statement!!!! not as if they have a record of everyone who enters the base or anything!!!!!

 

Last year I bought another off road bike from a friend of a friend (not road reg, so couldn't do hpi check) jumped through all the hoops to get it road reg and insured, 2 days later plod turned up and took it away because it was stolen!!!  took a statement at which point i asked how i can get my money back they said small claims court and there was nothing they could do despite me giving them a copy of all the emails, texts, paypal receipt etc etc, paypal wouldn't pay out because it was a vehicle, insurance company wouldn't pay out, credit card company wouldn't do owt either.

 

Before the coppers left they said "next time you buy something that ins't road reg ring us and we can check if it's been stolen or not"  phoned them to check before I bought my R1 engine, "we cant give that information out to the public"!!!!!   

 

you cant win these days

I have to agree with Deathrow. As infuriating as it is to be in this situation, trying to fight crime with crime is not the way to do things. We have a justice system in this country for a reason (the effectiveness of that system is questionable at times, but nevertheless, it is still there).

 

Investigating things and confirming details is one thing. Setting up bank transfers and DDs illegally is another thing altogether. And if it happens, and someone happens to see this thread, there is a good chance it is linked to you. You have the motive, and the means. As good as guilty before you set foot in court.

 

I also don't believe you should just let it go however. Keep hassling the Police, everyday if you have to. Write to your MP. TryCitizen's Advice. Try absolutely anything and everything you can think of. But accept that the money is gone. If you get it back, its a bonus.

 

For the record, being less trusting is probably a good thing as well. If something seems too good to be true, it probably is.

 

Oh, and if you are ever thinking of doing anything illegal or underhand, never ever post it on an internet forum. It has disaster written all over it.

Contact the police and crime commissioner for your force!

The only thing that complicates things is if he lives in a different county, who's responsible for investigating (ie where was the crime actually committed)

What annoys me about this is I think its a crime that has lines of enquiry that can be followed and can actually be solved!

If the offender is convicted he'll probably be ordered to pay 50p a week back, but that's not the fault of the police, the courts are completely seperate!

Pm me if you need any advice, and ask for justification as to why its not being investigated!

If you want to do things by the book then yes, small claims court is the only route you can go down if the Police aren't willing to treat it as a criminal offence. You just need his name and address to nab him.

 

Do remember though that if he has withdrawn the money and the court gives him a CCJ to pay it back and he says he has no money, you may still never get it or get it very slowly, as they say above, in dribs and drabs. Good luck.

Don't worry I don't do anything that isn't legal. Everything will be in my favour. Someone said it could take ages but they also mentioned bailiffs after you win court. But like I said to them, getting it back in drive and drabs is better than nothing at all.
