I have a K series Mini which has had engine and transmission, front subframe, suspension, steering column and rack all changed. The round nose has been swapped to clubman and seats have had modified brackets to bolt them more securely to to floor.

I printed out the full 64 page document from VOSA and took it to my MOT station and asked his opinion. He rang VOSA to confirm the 10 year ruling and then passed my modified Mini.

I then rang Graham Sykes insurance and confirmed the details of all the modifications with them. They had no problems insuring my Mini.

There does seem to be a lot of confusion over this issue. But I would say that I didn't have much trouble putting a highly modified Mini on the road.

I don't doubt Goaty's real life experience. However the 10 year rule is intended for importing older cars that have been registered abroad, a nice little loop hole for importing classic Ferraris, E types and other rich boys toys.

I can only think the rules got lost in translation and maybe they thought the modifications predated IVA 'n SVA testing.

so you are only driving your mini on building sites, quarries, ports and airports or are you turning it into a tank, tractor or fire engine ?

For vehicles being imported into the UK under the ‘Mutual Recognition’ provision, see Annex 7 on page 57.

Is this even relevant? I've sat and read it all again and the 10 year rule still applies. It's obvious I use my Mini on UK roads, just like thousands of other modified Mini and modified cars do.

I would like to say that unless a Mini has had it's seams removed, it won't pass an IVA test anyway as the tests are designed for newly built vehicles.

how do the Zcars pass with seams on then - as many have done ?

the IVA scheme as listed above is for imported vehicles and not relevant to a car that fails the DVLA's 8 points system that then needs a BIVA test



please post something up relevant to a mini needing a BIVA test

The new BIVA scheme will apply to new vehicles and vehicles up to 10 years old and will permit certain alternative standards such as US and Canadian standards, as is the case with SVA.

The word "and" means it includes US and Canadian. It is not specific to imports. Up to 10 years old means every Mini is now exempt from the test as they will be 12 years old minimum.

I'm sorry but you are reading these posts all wrong. You seem to be as though you think every car will need a IVA / BIVA test that has been modified. This is not a Mini issue. It's UK law.

Can you find something that says it should have gone for a BIVA test?

My car is up to UK MOT standard. That's all it needs to drive on UK roads.

a MOT test just shows it passes minimum standards on a few set items and not that the car is road worthy

That highlights the whole purpose of IVA. If you modify your car to earn enough points under the DVLA's scheme it will no longer be considered to be your over 10 year old Mini, but a new home built car made from 2nd hand parts. It will require an IVA to be registered to drive on the road.

You'd have to prove the car is over 10 years old in it's current form - an old car that's never been on UK public roads.

I'm still waiting for one single example of a modified mini being forced down the IVA route, whereas there must be hundreds if not thousands of modified minis on the road as we speak
